Terms of Service

Version 1.0 · effective October 15, 2026

Terms of Service

Effective date: October 15, 2026

1 Operator and scope

Pure Memorial at purememorial.com (the “Service”) is operated by Grigorev Andrei, an individual entrepreneur, established in the Republic of Kazakhstan, registration details Individual Identification Number (IIN) 840504050150, registered address 140 Aymanova Street, Almaty 050057, Republic of Kazakhstan (the “Operator”, “we”, “us”). For support, legal notices, privacy requests and complaints, email support@purememorial.com.

These Terms govern the Service. Mandatory consumer rights prevail over conflicting wording. Paid purchases through Polar are made from Polar Software, Inc., acting as merchant of record and reseller. Its Buyer Terms govern that sale; we remain responsible for our own Service obligations.

2 Acceptance and eligibility

You accept these Terms when you expressly agree during registration or another process presenting them. You must be eighteen or older and legally capable of creating an account, buying a plan or submitting content. Accounts are intended for personal family remembrance. Public pages, and Unlisted pages through their link, may be viewed without an account.

A visitor without an account (a “guest”) may leave a memory on a page they can open where the creator allows memories. Before submitting, the guest confirms in the memory form that they are eighteen or older and accept these Terms. We record that confirmation, the Terms version and the time with the memory. These Terms apply to the guest’s memory and conduct; a guest does not receive an account.

We record your age confirmation and the version and date of acceptance. When a new Terms version takes effect, the account flow asks for renewed acceptance. You may instead export your data and delete your account. Reading this policy, browsing or accepting these Terms does not replace a separate consent required for personal-data processing.

3 Accounts

Provide accurate account information, protect your credentials and promptly report unauthorized access. Contact support to change your account email. You are responsible for your conduct and access you authorize, not for our security failures or events beyond your control.

An account or subscription does not establish ownership of a deceased person’s identity, estate or family history. Do not impersonate others or falsely claim authority over a memorial.

4 Available features

The Service provides memorial pages with names and dates, biographies, epitaphs, life-story chapters, photographs and covers, optional faith symbols and resting-place information, visitor memories, verification, invitations, date reminders and data export. Availability depends on the page’s settings, verification and plan.

Only features actually offered at purchase are included. Video uploads, joint management and automatic legacy transfer are not currently offered. Future-feature announcements are not a delivery commitment. Maps and user-entered locations may be inaccurate; check access conditions before travelling. The Service is not an official registry or an inheritance, medical or legal service.

5 Creating and managing a memorial

Create a page only for someone you reasonably believe is deceased. Use accurate names and dates to the best of your knowledge, distinguish recollections from established facts and correct material errors. A memorial for a deceased child must be created by an adult with the necessary authority and permissions.

The creator controls settings and may edit or delete the memorial. Anyone who can open the page, including guests, may contribute memories where the creator has enabled them. The creator may hide or delete any memory on their memorial. Invitations do not confer ownership, editing rights or access to Private pages. A creator does not acquire a contributor’s copyright by moderating their work. Do not expose unnecessary identifying or sensitive information about living people.

6 Visibility and copies

New memorials are Unlisted by default. Public pages are visible to anyone; verified Public pages that are not restricted may be indexed. Unlisted pages are available to anyone with their link, which can be forwarded. They are excluded from our sitemap and we ask search engines not to index them. Unlisted is not confidential storage. Private restricts page access to the creator and authorized staff, not a family access list. Pages that are not verified show visitors a notice that they are family pages that have not been verified.

Normal photograph delivery checks access settings. Public photo responses can remain cached for one hour; other photo responses may remain in the browser cache for five minutes. Share-preview cards may remain in our delivery cache for a week. Previously issued temporary file links can work until expiry unless the file is removed. Emails, downloads, screenshots and third-party previews are not recalled by a setting change or deletion.

Turning off the photo gallery or memories hides those sections without deleting their content. A separately selected cover can remain visible when the gallery is disabled. Hiding a resting place prevents its ordinary display but does not delete the stored location. Use deletion or edit controls, or contact support, when you want information removed. Public and Unlisted previews can disclose a name, dates and photograph.

7 Verification

Verification is optional. An unverified memorial is a family page: it can accept memories, send invitations and accept reminder subscriptions like a verified one. Unverified pages are excluded from our search sitemap, are not indexed and do not show the Verified badge. Their visibility still controls who can view them, and an unverified Public page is not offered to search engines.

Submit only a genuine death certificate or another accepted official death record you may lawfully provide. Do not submit passports, identity cards or unrelated records. Contact us before uploading to discuss obscuring unnecessary information about living people.

Instead of uploading it themselves, the creator may send a private upload link to a relative or another person who holds the certificate. A link works once, for fourteen days, and only while the memorial is not verified or under review; the creator can cancel it at any time and should send it only to someone they trust. The person who opens it does not need an account. Before uploading, they confirm that they are eighteen or older, accept these Terms and that the document is genuine, and the rules in this section apply to them as to the creator. The submission belongs to the creator's memorial, and its result is sent to the creator.

Documents are stored privately in Supabase and sent to Anthropic’s Claude artificial intelligence system for checking. Reviewer emails through Resend and Gmail can contain extracted details. The Privacy Policy explains recipients, transfers and retention. A submission can be approved automatically; only a human reviewer rejects a verification document. The system can err and does not perform an official registry search or forensic authentication.

Verified means a submission passed our document review at a particular time. It does not certify the biography, kinship, authority, copyright or inheritance rights. Changing the memorial’s name or dates removes the badge pending renewed verification. We may recheck or revoke it for a substantiated reason, with human review available.

8 Content rights

You retain your rights in content and must hold the rights and permissions needed to submit it. Family relationship alone does not confer a photographer’s copyright. Respect applicable rights of living people, relatives, heirs and other rightsholders.

You grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, resize, format, moderate, display and transmit your content to operate the Service under its visibility settings. This includes previews, exports and necessary provider processing. The licence does not authorize independent advertising use, sale of your content or training general-purpose artificial intelligence models.

The licence ends when content is deleted, except to the limited extent needed for lawfully retained records or restricted backup copies described in the Privacy Policy. It does not override deletion rights or give us a perpetual right to publish deleted memorials.

9 Content rules

Do not publish false death notices, unlawful private information, threats, harassment, fraudulent or infringing material, sexually explicit or exploitative content, discriminatory hatred, graphic cruelty, glorification of violence or self-harm, spam or commercial solicitation. Respectful accounts of illness, war, suicide or grief are not prohibited merely by their subject.

The Service is for family remembrance. Fan pages, political tributes and celebrity or political-figure photographs are prohibited under our current content rules. Do not bypass access controls, harvest personal data, exploit vulnerabilities, submit memories automatically or in bulk, or disrupt the Service. Report vulnerabilities privately to support. Ordinary search and preview crawlers may follow our published crawling rules; mandatory lawful uses remain permitted.

10 Moderation and complaints about content

Claude screens photographs and submitted text, including biographies, epitaphs, life stories, visiting information, captions, memories and invitation notes. Screening may approve, reject or hold content. If checking fails, some owner text and invitation notes may still be saved or sent, while photographs and memories may wait for human review. Publication does not guarantee screening or accuracy. Memories from guests are screened in the same way as memories from account holders. To prevent abuse and control checking costs, we limit how many memories can be sent from one network connection and to one memorial within a period, and we may discard submissions that appear automated.

A report that the person is alive, or reports from three different accounts, can hide a memorial automatically pending review. This is a precaution, not proof. We may proportionately restrict content or access to protect people, enforce these rules or comply with law.

Use the reporting feature or email support without an account. Include the content link, specific reasons, supporting information, your contact details and a good-faith statement of accuracy. We acknowledge notices where contact information is available and communicate decisions, reasons, relevant rules, the role of automation and available remedies, subject to lawful restrictions.

You may request free human review at support, explain your position and challenge a decision. We correct mistakes and observe applicable complaint deadlines. Where Kazakhstan law requires a response to an objection to automated personal-data processing within three working days, that deadline applies. Statutory remedies and access to courts remain available.

11 Copyright and family disputes

For copyright complaints, identify the work, disputed material and link, your authority, reasons and contact details. We may request proportionate evidence, restrict disputed content, invite a response and restore content where appropriate under applicable procedures. Substantiated repeated infringement may lead to account termination; an allegation alone is not a finding.

Relatives, affected people and authorized representatives may request correction, removal or a review of management rights. We may verify identity and authority and contact affected parties where lawful. We do not adjudicate inheritance disputes. There is no automatic transfer after inactivity. Any agreed management transfer requires lawful authority and must not expose the previous creator’s account or verification documents.

12 Plans and cancellation

Free currently allows one memorial and ten gallery photographs per memorial. Premium allows memorials without a fixed account count and up to fifty gallery photographs per memorial. A separate custom cover does not count toward the gallery limit. File and abuse limits apply. Your purchase offer and confirmation specify the price, currency, taxes, billing interval and included features. Forever is not currently offered for purchase.

Monthly and annual subscriptions renew automatically until cancelled. Cancel through Polar’s portal linked from Plan & billing or contact support@polar.sh; our support can assist. Cancellation normally preserves Premium until the paid period ends and stops future renewals. It is separate from a refund or statutory withdrawal. When Premium ends, existing content is not deleted solely for exceeding Free limits. Further additions over those limits are blocked, and visitors see only ten gallery photographs on each memorial: the main photograph and the next nine in gallery order. The others are kept and shown again if Premium resumes.

Price increases for an existing subscription apply only to future renewals after at least thirty days’ notice and any legally required consent. You can cancel before the increased charge.

13 Refunds and statutory withdrawal

We do not offer an additional voluntary refund window. Refunds remain available under mandatory law and these Terms, including for a paid service not supplied as required. Polar may grant refunds under its own rules. Send your request and purchase reference to our support or Polar. We coordinate refunds due for our Service through the sale channel. A refund alone does not cancel renewal; specify if you also want cancellation.

Where applicable European Economic Area or United Kingdom distance-contract rules provide a withdrawal right, you may withdraw without a reason within fourteen days after concluding the service contract. Statutory extensions and greater local protections remain available. Send a clear statement to either support address before the deadline; we forward Polar-related notices promptly. Appendix A is optional.

Where legally required, use the online withdrawal function at purememorial.com/withdrawal. Acknowledgement of the notice, its content and submission date and time is provided on a durable medium, such as email, without undue delay. Subscription cancellation alone does not replace this function.

Valid statutory withdrawal is reimbursed without undue delay and within fourteen days of notice, without a refund fee, normally using the original payment method. A deduction for service already supplied is allowed only when legal conditions are met, including required information and an express request for early performance. Immediate access alone does not waive withdrawal. Loss of that right through full performance requires all legally required consents and acknowledgements. Defective-service and other mandatory remedies remain available.

14 Export

Your data in the dashboard provides a ZIP archive with available account and memorial records as readable text, photographs in their stored web versions and submitted verification files. It is not a complete copy of every internal or provider record. Contact support for missing records or an eligible machine-readable portability copy.

Standard photo uploads resize and reformat images and remove original metadata. Keep your originals. The automated export limit is five downloads per twenty-four hours and does not restrict statutory rights. Secure exported files, which may include private documents and other people’s data; downloading does not transfer their rights to you.

15 Deletion

Delete memorials through owner controls or your account through Delete account, confirming your email address. Successful account deletion is irreversible through the Service and removes your profile, memorials and their content, and your own memories and reports. Export first if needed. File removal is attempted during deletion; scheduled cleanup retries remaining orphaned files. Caches and lawful retained records are addressed in the Privacy Policy.

A guest cannot edit or delete a memory through the Service. To have their memory removed, a guest may ask the memorial’s creator or email support with the page link, the name used and the text or approximate time of the memory. We may ask for proportionate details to confirm that the request comes from its author, and we remove the memory where the request is substantiated or the memory breaches these Terms. Deleting a memorial removes the memories on it, including guests’ memories.

Before account deletion, we ask Polar to cancel renewing subscriptions at the end of the paid period. If cancellation fails, deletion does not proceed; contact support. Deleting a memorial does not cancel a plan. Account deletion does not itself refund unused time or automatically erase payment records, invitation records, email logs, mailbox messages or provider-held copies. We assist with valid deletion requests and charges improperly made after effective cancellation.

16 Suspension and service closure

We may suspend or terminate access for material breach, credible fraud, repeated abuse, serious security risks or legal requirements. Measures must be proportionate; where practicable, we notify you and allow correction. Urgent protective action may precede notice. Human review remains available.

If we permanently discontinue the Service, we will give at least thirty days’ notice where reasonably possible and a reasonable export opportunity, subject to urgent legal or security restrictions. We assess refunds for unprovided paid service under applicable law and purchased entitlements. Suspension or closure does not automatically entitle us to retain unearned advance payments. No indefinite preservation or permanent availability is promised.

17 Service standards and liability

We provide the Service with reasonable care and skill and honour purchased descriptions and mandatory conformity duties. We cannot promise uninterrupted availability, error-free moderation or authenticity of every record. Keeping your own copies does not relieve us of our duties.

Consumers retain liability and remedies provided by law, without a contractual monetary cap or blanket indemnity. For separately permitted non-consumer use, our aggregate liability is limited, where lawful, to the greater of USD 100 and Service payments in the preceding twelve months, including purchases through Polar.

No limitation excludes fraud, intentional misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, mandatory data-protection rights, promised refund remedies or other non-excludable liability. Claims against a user require an applicable legal basis.

18 Changes

We may change these Terms or features for legal, security, abuse-prevention, maintenance or service-improvement reasons. Material changes receive at least thirty days’ advance notice through a prominent Service notice or email, plus any legally required delivery method. Justified urgent legal or security changes may take effect sooner with prompt explanation.

Changes do not remove accrued rights or materially reduce purchased entitlements without required remedies. Where an adverse change permits termination, you may end the affected service without penalty and receive any refund due. Required express acceptance is not replaced by continued use. New and earlier versions appear on the Terms page. Events outside our control do not automatically excuse mandatory refunds or liability.

19 Communications and reminders

We send necessary account, security, verification, moderation and service communications. Creators receive birthday and death-anniversary reminders by default, including for memorials that existed when reminders were introduced. Other signed-in users choose Remind me on an eligible memorial. Reminders are scheduled a week and a day before the date; delivery is not guaranteed. Stop them in the memorial controls or using the email link without signing in. Any separate choice required by law must be obtained.

Invite only people you know who would reasonably expect this personal invitation and whose address you may lawfully share. Do not send advertising, address-list campaigns or repeated unwanted messages. Invitations identify the sender and include an opt-out. The number of invitations a sender can send per day is limited. Stopping invitations is separate from stopping reminders or necessary account messages. The Privacy Policy explains processing.

20 Law and disputes

Send complaints to support with relevant details and your requested remedy. We respond without undue delay and within mandatory deadlines, including ten calendar days where Kazakhstan consumer law requires it. Contacting us first does not restrict statutory remedies.

Kazakhstan law governs these Terms without depriving consumers of mandatory protections applicable in their habitual residence. Disputes may be brought in any competent court, including local consumer courts where law permits. These Terms impose no mandatory arbitration or class-action waiver. Polar’s separate dispute provisions apply only to its sale relationship and only where lawful.

21 Other provisions and language

These Terms and your confirmed purchase offer govern our Service agreement; the Privacy Policy separately explains processing. Mandatory law, specific purchased rights and protected pre-contract statements prevail over inconsistent general wording. A lawful business transfer must carry our obligations and preserve users’ statutory rights. You may not sell or transfer an account without an agreed lawful process.

An unenforceable provision does not invalidate the rest where lawful. Non-enforcement once is not a waiver. Accrued rights and provisions concerning lawful retained data and disputes survive only as needed. English and Russian versions express the same terms; no translation discrepancy may remove mandatory rights or impose a less favourable undisclosed term than the version accepted.

Appendix A Optional withdrawal form

Send only if exercising an applicable statutory withdrawal right. A clear statement in your own words is sufficient.
